What happened
On September 9, Texas Democratic U.S. Senate nominee James Talarico told Fox News he would oppose transgender athletes in girls’ sports if their participation risked safety or fairness, and that he would support a national ban on gender-transition surgeries for minors. On September 13, at Houston’s Wheeler Avenue Baptist Church, The Daily Wire recorded Talarico telling a woman posing as a supporter that his position on transgender issues “hasn’t changed,” that he would fight for trans kids in the Senate as he had in the Texas Legislature, and that sports eligibility should be decided locally, sport by sport and athlete by athlete. As a state representative, Talarico voted against 2021 legislation requiring public-school athletes to compete according to the sex listed on their birth certificates and against 2023 legislation restricting certain transition-related medical procedures for minors. Additional recordings released by the same outlet captured a minister at Talarico’s Austin church and a Texas Democratic Party-affiliated manager describing his recent messaging as an effort to broaden his appeal. The Talarico campaign did not respond to requests for comment.
Sourcing check · Mostly on the record · 3 articles
2 of 3 articles cite a named source for the story. It was on the record from the first report.
What these terms mean and how they're counted
- On the record · names a source 2 of 3
- On the record means the article cites a source by name for the story's main claim: a person, or an institution speaking officially, such as a company statement or a named agency's spokesperson. The opposite is an unnamed source. The count is how many of the counted articles cite at least one such source; the names are everyone named across them, each once however the articles spell it. Here: James Talarico and Jennifer Miranda
- Primary evidence · cites a document or data 3 of 3
- Primary evidence means the article cites a record you could check yourself: a court filing or ruling, a dataset or report, a recording or transcript, an official statement or press release, market data. A quote is not a document. The count is how many articles cite one. Here: undercover video recording, video recording, video, interview
- Credits another outlet 0 of 3
- The article says the story comes from another outlet's reporting (“first reported by Reuters”). Those articles relay the story; they are not independent confirmation. Here: Each article presents its own reporting.
- Unnamed sources 0 of 3
- The main claim is attributed to people who are not identified: “people familiar with the matter”, “officials said”. The count is how many articles do this.
- How it developed
- When the first report landed and whether it named anyone; when the first named source and the first document appeared. Here: First report Sep 29, 13:05 UTC by Daily Wire, naming its source. First document in the first report, from Daily Wire (undercover video recording).
- Not counted 0
- Opinion, analysis and video pieces, and articles too short to assess. Every count above is out of the counted articles. An article republished under a new headline is one article.

Unpacked
Left-leaning coverage has not reported this story. Right-leaning coverage says James Talarico told a woman posing as a supporter that his position on transgender issues "hasn't changed," after a Fox News appearance in which he said he would oppose trans athletes in girls' sports if safety or fairness were at risk. Daily Wire and Breitbart treat the church recording, plus his votes against Texas bills on school sports and procedures for minors, as the live record. A reader of the silent side never sees that clip or that pairing.
Right-leaning outlets split on what to put first. Daily Wire opens on the exclusive September tape. The Federalist opens on a House speech in which Talarico told trans kids "I love you."
How would he vote on a federal sports or surgery bill if both the Fox limits and the church-door pledge are still in force?
Bottom line
Miss Daily Wire and you miss Talarico on tape promising to fight for trans kids in the Senate as he did in Austin, after his Fox News sports caveat. Left-leaning coverage has not reported that recording.
The receipts — 5 facts one side's coverage lacks
- Talarico told a purported supporter at Houston's Wheeler Avenue Baptist Church that his position hadn't changed and he would fight for trans kids in the Senate as he had in the legislature.
- In the same recording Talarico said trans sports eligibility should be decided locally, sport by sport and athlete by athlete, and that he had the most inclusive policy of any candidate running.
- Talarico voted against Texas Senate Bill 14, the 2023 law restricting certain sex-transition procedures for minors.
- On Fox News Talarico said he would absolutely support a national ban on gender-transition surgeries for minors.
- Talarico's campaign did not respond to requests for comment on the video.
The Right View
Daily Wire, Breitbart, and The Federalist frame the September 13 recording as evidence that Talarico’s Fox News comments were a political makeover, not a change of position. They quote him saying “Always” when asked whether he would defend a trans niece’s ability to compete in women’s sports, that he would fight for trans kids in the Senate as he had in the legislature, and that he has “the most inclusive policy of any candidate who’s running.” The outlets pair those lines with his votes against Texas Senate Bill 29 / House Bill 25 (athlete eligibility by birth-certificate sex) and Senate Bill 14 (limits on certain medical procedures for minors), and they quote Paxton campaign spokeswoman Madison Cercy calling him a hypocrite and flip-flopper. They also cite undercover clips of Rev. Babs Miller predicting he would “change his tune back” after the election and of Jennifer Miranda saying he “does believe the things that he’s said before” but is trying to be “more palatable to Republicans.” The Federalist further recounts Talarico’s 2021 remarks that some things matter more than “perfectly fair competition” and disputes Politifact’s rating of related Republican ads.
Our Take (balanced)
The story is substantive: it turns on named actors, dated public statements, attributed quotes from a published recording, and a checkable legislative voting record, not a single anonymous allegation. Established on the open record are Talarico’s September 9 Fox News interview, his votes against the 2021 athlete-eligibility bills and 2023 minor-procedure restrictions, and the outlets’ publication of the purported September 13 remarks. What remains alleged until independently reviewed is that the church encounter and the Miller and Miranda clips are complete and fairly edited, and that “my position hasn’t changed” was a walk-back of the Fox comments rather than a claim that local, case-by-case sports rules can sit alongside other stated limits. No left-leaning outlet has reported this. Watch for a Talarico campaign on-the-record response, release of unedited video, and independent corroboration of the recordings.
